BASIC INFORMATION
The Civilian Misconduct Program operates under Army Europe Regulation 27-9. (See useful links section). This regulation pertains to all family members, Department of the Army Civilians, contractors and retirees and their families receiving logistical support from USAG Grafenwoehr, no matter where the sponsor is stationed. (See AE Regulation 27-9 page 1)
HOW IT WORKS:
1. Civilian misconduct cases are forwarded to the Assistant Civilian Misconduct Action Authority (ACMAA) from the Provost Marshal and the Criminal Investigation Command and through investigation by the ACMAA. These reports summarize the investigation and include the titled offense(s) opined by the Staff Judge Advocate’s Office (SJA).
2. Administrative action based on the title and previous offenses is staffed by the ACMAA through local agencies, the unit and the USAG Grafenwoehr Command Group. All bars to entry and command early returns are signed by USAG Grafenwoehr Commander and all other adverse actions are signed by the Deputy USAG Commander. Both are considered the Civilian Misconduct Action Authority (CMAA) IAW AER 27-9.
3. These actions include: non-adverse actions such as community service and letters of warning and adverse actions, which include the loss of a statutory right such as ID card privilege or command sponsorship, command referral or community service. Due process is completed in all adverse actions.
AGENCIES INVOLVED: See also Who’s Who section
a. Provost Marshal/CID: Respond to, investigate, assure SJA opine, send final cases to CMAA.
b. Staff Judge Advocate Administrative Law Section: Opines on investigated cases, noting probable cause, provide legal assistance to those individuals and sponsors who need assistance with CMAA cases and reviews Early Return of Dependents, bars and rebuttals. Provides opines on procedures or special cases.
c. ACMAA: investigate, coordinate administrative action as noted, above, assure due process and reporting of final action to PMO/CID; advise Command Group on administrative actions, prepare documents, coordinates command referrals and community service.
d. Unit/Agencies: Supervisor or 1SG or Commander is responsible for providing information to Command Group to coordinate cases, assure receipt of documents and coordinate actions such as ID card restrictions and command directed early return of dependents.
5. ADDITONAL INFORMATION: When affiliated personnel are involved in misconduct in the German economy most cases are investigated by both the German police and PMO/CID. These cases are then processed as, above. In these cases, the German courts and the CMAA can take administrative action. For example, there could be a fine by the German authorities as well as a CMAA adverse action.
